Can I apply for a family-based Green Card?

You can apply for a Green Card through your family member if you are the:

  • Spouse, parent, or child (referred to as immediate relatives) of a U.S. citizen
  • Adult child of a U.S. citizen
  • Sibling of a U.S. citizen
  • Spouse or unmarried child of a lawful permanent resident (Green Card holder)
  • Widow(er) of a U.S. citizen

Can I apply for a Green Card using adjustment of status?

There are a lot of requirements you must meet to get a Green Card through adjustment of status. You could be eligible for family-based adjustment of status if:

  • You are physically in the United States.
  • You have a family member who is a U.S. citizen or lawful permanent resident, have an approved petition from USCIS (or your family member will file a petition for you), and your priority date is current.
  • You meet the requirements to self-petition.
  • You entered the U.S. on a K-1 fiancé(e) visa and you married the person who petitioned for you within 90 days of entering the U.S. (If you married more than 90 days afte entry, it may still be possible to adjust status.)
